Media Release Consent for Photography, Video and Audio
The Releasing Parties (as defined below) understand that sometimes staff, photographers, newspaper and/or television reporters, and public relations personnel may be present during an Event (as defined below) and hereby authorize the MindBuilders Parties (as defined below) to photograph, video, film, and/or interview the Releasing Parties and to use their statements, image, voice, likeness and/or story, in any format, including photos, film, video, audio, print or electronic, in any and all media, whether now known or hereafter devised, in whole or in part, in perpetuity, for any lawful purpose whatsoever without restriction and without compensation or further approval.
Event Liability Disclaimer and Release
In consideration of the Releasing Parties being allowed to register for, attend, and/or participate in, an event, activity, or experience (“Event”), on behalf of the Releasing Parties, I hereby waive, release from liability, assume all risks, and covenant not to sue the MindBuilders Creative Arts (“MindBuilders”), its affiliated organizations and their respective directors, officers, employees and agents, volunteers, and others present at the program (the “MindBuilders Parties”) for any expense, loss, damage, personal injury (including loss of life, disability, or serious harm), property damage or theft, negligence, or actions (each, a “Loss”) resulting from or arising in connection with the Releasing Parties’ travel to, attendance at, or participation in the Event and any related activities unless said Loss is caused by the sole, gross negligence or willful misconduct of MindBuilders, as determined by a final nonappealable ruling of a court of competent jurisdiction. I agree that this waiver and release shall bind me and my personal representatives, family members and other accompanying attendees (the “Releasing Parties”), shall be enforceable to the fullest and broadest extent of the law, and, if any portion is held invalid, the remainder should continue in full legal force and effect. I am an adult of sound mind and capable of entering into this waiver on behalf of the Releasing Parties. I have read its terms and fully understand and agree to the provisions herein. I agree that this waiver shall be governed by and construed in accordance with the laws of the State of New York.
On behalf of the Releasing Parties, I understand and am aware that the Releasing Parties’ participation in the Event involves risk, including, but not limited to, travel, physical activity, locales where public health and safety may be at risk, or activities that involve risk that any of the Releasing Parties create for others or others may create for any of the Releasing Parties. These risks may lead to a Loss, and the Releasing Parties nonetheless choose to participate in the Event. I am also aware that despite there being potential risks that I may not have considered, the Releasing Parties waive any right they may have to any claims that may occur from such unconsidered risks, and choose to participate in the Event. I acknowledge that no promises, representations, or affirmations of fact were made to me by MindBuilders or its representatives concerning the safety or danger associated with traveling to the Event or participating in any activity or interaction related to or associated with the Event.
The Releasing Parties agree to indemnify and hold harmless the MindBuilders Parties from any loss, liability, damages, or costs the MindBuilders Parties may incur, whether caused by negligence or willful misconduct, active or passive, or otherwise, by any of the Releasing Parties, in connection with their participation in the Event.
